{"id":6358,"date":"2022-11-01T11:36:26","date_gmt":"2022-11-01T14:36:26","guid":{"rendered":"https:\/\/bottrelfanchioti.com.br\/?p=6358"},"modified":"2022-11-01T11:36:26","modified_gmt":"2022-11-01T14:36:26","slug":"empregada-dispensada-em-pleno-tratamento-contra-o-cancer-sera-reintegrada","status":"publish","type":"post","link":"https:\/\/bottrelfanchioti.com.br\/empregada-dispensada-em-pleno-tratamento-contra-o-cancer-sera-reintegrada\/","title":{"rendered":"Empregada dispensada em pleno tratamento contra o c\u00e2ncer ser\u00e1 reintegrada"},"content":{"rendered":"<p>Uma empregada da empresa ENERGISA SA que foi demitida quando estava fazendo tratamento para investigar a ocorr\u00eancia de <strong>c\u00e2ncer de mama<\/strong>, ser\u00e1 reintegrada e receber\u00e1 todos os sal\u00e1rios desde a dispensa at\u00e9 a efetiva reintegra\u00e7\u00e3o.<\/p>\n<p>A Justi\u00e7a do Trabalho de Corumb\u00e1 entendeu que<strong> a demiss\u00e3o ocorrida foi discriminat\u00f3ria<\/strong>, motivada exclusivamente pelo estado de sa\u00fade da empregada. Para a Ju\u00edza que analisou o caso <em>\u201co poder de demitir do empregador n\u00e3o \u00e9 absoluto nem pode estar dissociado da fun\u00e7\u00e3o social do trabalho e do direito \u00e0 vida, \u00e0 dignidade da pessoa humana e \u00e0 n\u00e3o-discrimina\u00e7\u00e3o\u201d<\/em>.<\/p>\n<p>A decis\u00e3o foi confirmada pelo Tribunal e, o recurso da empresa para o Tribunal Superior do Trabalho, foi rejeitado.<\/p>\n<p>Embora n\u00e3o seja uma doen\u00e7a ocupacional, a legisla\u00e7\u00e3o atual pro\u00edbe <strong>pr\u00e1ticas discriminat\u00f3rias<\/strong> para acesso \u00e0 rela\u00e7\u00e3o de trabalho ou de sua manuten\u00e7\u00e3o, o que pode ser constatado na Lei 9.029\/1995.
